Regulations on Travelling with Children

Below information is from the South African Home Affairs Department website, under Regulations on Travelling with Children.

TRAVEL DOCUMENTS NEEDED WHEN CHILD IS TRAVELLING
• Valid passport of travelling parent/s and child
• Valid visa, if required
• Unabridged Birth Certificate (UBC) or equivalent document, if country of residence does not issue a UBC

WITH BOTH BIOLOGICAL PARENTS
• Valid passports of both parents and child

WITH BOTH ADOPTIVE PARENTS
• Plus one of the following
o Court order confirming the adoption of the minor by the adoptive parent(s)
o Adoption Certificate
o Unabridged Birth Certificate (UBC) or equivalent document reflecting particulars of adoptive parent(s) or biological parent(s)

WITH BOTH LEGAL GUARDIANS
• Guardianship Order

WITH 1 PARENT WHERE PARENTS ARE BIOLOGICAL PARENTS AND BOTH ARE ON THE UNABRIDGED BIRTH CERTIFICATE
• Plus one of the following
o Parental Consent Affidavit (PCA) not older than 4 months
o Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.

WITH 1 PARENT WHERE PARENTS ARE ADOPTIVE PARENTS
• Plus one of the following
o Unabridged Birth Certificate (UBC) or equivalent document reflecting particulars of adoptive parent(s) or biological parent(s)
o Court order confirming the adoption of the minor by the adoptive parent(s)
o Adoption Certificate
• Plus one of the following
o Parental Consent Affidavit (PCA) not older than 4 months
o Guardianship Order
o Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.

WITH 1 PARENT WHERE PARENTS ARE DIVORCED (OR LEGALLY SEPARATED), WITH EQUAL PARENTAL RIGHTS AND RESPONSIBILITIES
• Plus one of the following
o Parental Consent Affidavit (PCA) not older than 4 months
o Court order granting FULL parental responsibilities and rights to the travelling parent
o Court order granted in terms of section 18(5) of the Children’s Act, 2005
o Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.

WITH 1 PARENT WHERE PARENTS ARE DIVORCED (OR LEGALLY SEPARATED), WITH FULL PARENTAL RIGHTS AND RESPONSIBILITIES
• Court order granting FULL parental responsibilities and rights to the travelling parent

WITH 1 LEGAL GUARDIAN, WHO HAS JOINT LEGAL GUARDIANSHIP
• Guardianship Order
• Plus one of the following
o Parental Consent Affidavit (PCA) not older than 4 months
o Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.

WITH 1 LEGAL GUARDIAN, WHO HAS FULL LEGAL GUARDIANSHIP
• Guardianship Order

WITH 1 PARENT WHERE PARENT IS WIDOWED (BIOLOGICAL PARENTS)
• Death certificate of the deceased parent

WITH 1 PARENT WHERE PARENT IS WIDOWED (ADOPTIVE PARENTS)
• Death certificate of the deceased parent
• Plus one of the following
o Unabridged Birth Certificate (UBC) or equivalent document reflecting particulars of adoptive parent(s) or biological parent(s)
o Court order confirming the adoption of the minor by the adoptive parent(s)
o Adoption Certificate

UNACCOMPANIED, WHERE PARENT IS A SINGLE PARENT (I.E. ONLY ONE PARENT ON THE UNABRIDGED BIRTH CERTIFICATE)
• Parental Consent Affidavit (PCA) not older than 4 months
• Letter from the person who is to receive the minor in South Africa or foreign country; containing his or her residential address and contact details where the minor will be residing.
• Proof of identity of the person who is to receive the minor in South Africa or foreign country; either copy of the identity document, or valid passport and visa, or permanent residence permit
• Contact details of the parents or legal guardian of the minor

UNACCOMPANIED, WHERE PARENTS ARE NOT MARRIED, BUT BOTH PARENTS ARE ON THE UNABRIDGED BIRTH CERTIFICATE

• Letter from the person who is to receive the minor in South Africa or foreign country; containing his or her residential address and contact details where the minor will be residing.
• Proof of identity of the person who is to receive the minor in South Africa or foreign country; either copy of the identity document, or valid passport and visa, or permanent residence permit
• Contact details of the parents or legal guardian of the minor
• Plus one of the following
o Parental Consent Affidavit (PCA) not older than 4 months
o Court order granting sole parental rights and responsibilities

o Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.

TRAVEL DOCUMENTS NEEDED WHEN CHILD HAS A SINGLE PARENT (I.E. ONLY ONE PARENT ON THE UNABRIDGED BIRTH CERTIFICATE), AND CHILD IS TRAVELLING WITH AN ADULT THAT IS NOT A PARENT NOR LEGAL GUARDIAN

• Parental Consent Affidavit (PCA) not older than 4 months

UNACCOMPANIED, AND CHILD IS IN ALTERNATIVE CARE (I.E. FOSTER CARE, YOUTH CARE CENTRE, TEMPORARY SAFE CARE

• Letter from the Provincial Head of the Department of Social Development where the child resides, authorising his or her departure from the Republic as contemplated in section 169 of the Children’s Act.
• Letter from the person who is to receive the minor in South Africa or foreign country; containing his or her residential address and contact details where the minor will be residing.
• Proof of identity of the person who is to receive the minor in South Africa or foreign country; either copy of the identity document, or valid passport and visa, or permanent residence permit
• Contact details of the parents or legal guardian of the minor

TRAVEL DOCUMENTS NEEDED WHEN CHILD IS AN ORPHAN (I.E. WITHOUT LEGAL GUARDIAN OR ADOPTION YET)

• Letter of Special Circumstances issued by Director-General of Home Affairs in the event that a parent or parents are incapacitated or deceased and no legal guardian has been appointed as yet.
